1. About BodyPlan

BodyPlan provides AI-generated fitness plans, calorie information, and tracking tools for general wellness and educational purposes only. BodyPlan is not a medical or healthcare provider, is not regulated by the Care Quality Commission (CQC) in the United Kingdom, and is not cleared or approved by the U.S. Food and Drug Administration (FDA) or any other regulator as a medical device or service. Nothing on the platform constitutes medical advice, diagnosis, treatment, prescription, or a doctor–patient relationship. Always consult your doctor or another suitably qualified health professional before beginning, changing, or stopping any exercise, nutrition, or wellness program, and follow their advice over any information provided by BodyPlan.

By using BodyPlan you acknowledge that participation in fitness, nutrition, or exercise activities carries inherent risks. You voluntarily assume full responsibility for your use of the service, including any reliance on AI-generated content. BodyPlan, its creators, and affiliates disclaim all liability for injury, illness, or other consequences that may result. To the fullest extent permitted by law, you waive and release any claims against BodyPlan arising from your use of the service.

Nutritional guidance provided via BodyPlan is general information only and is not a substitute for advice from a registered dietitian, nutritionist, or other licensed professional.

By using BodyPlan, you agree to these Terms. If you do not accept them, you must not use the service.

2. Eligibility and Accounts

  • You must be at least 18 years old (or older if required by local law) to use BodyPlan.
  • You must provide accurate registration details and keep your login credentials secure.
  • You are solely responsible for all activities under your account.
  • We reserve the right to suspend or terminate your access at our discretion, including for breach of these Terms or misuse of the service.

3. Use of the Service

  • You agree to use the service only for lawful purposes.
  • You must not attempt to disrupt, reverse engineer, or misuse the service.
  • Content you submit (e.g., workouts, stats) remains yours. You grant us a licence to process, store, and display it for the purpose of providing the service.
  • You must not upload unlawful, harmful, or infringing content.

4. Health and Safety Disclaimer

  • Inherent Risks: Fitness, exercise, and nutrition activities carry inherent risks, including injury or illness. You voluntarily assume all risks associated with your participation.
  • No Guarantees: We do not guarantee specific health or fitness outcomes.
  • Stop if Unwell: If you experience pain, dizziness, or other adverse symptoms, stop immediately and seek medical advice.
  • Medical Priority: Always follow the advice of your doctor or qualified health provider, even if it conflicts with BodyPlan’s outputs.

BodyPlan is not an emergency service and must not be used for urgent or life-threatening situations. If you suspect you have a medical emergency, call the applicable emergency services in your jurisdiction (for example, 999 in the UK or 911 in the USA) immediately.

Users in the United States acknowledge that BodyPlan does not provide services that require state licensure (including physician, physical therapy, or dietetics services) and that BodyPlan content should be used only after receiving clearance from a licensed practitioner. Users in the United Kingdom acknowledge that BodyPlan is a wellness tool and not regulated healthcare, and that they should seek guidance from their GP or other registered professional before acting on any recommendations.

5. Fees and Payments (if applicable)

Some features may require payment. Pricing and billing terms will be presented in-app. Taxes may apply depending on your jurisdiction. Unless required by law, all payments are final and non-refundable once services are provided.

6. Intellectual Property

The BodyPlan service, its software, content, branding, and trademarks are owned by BodyPlan Limited (excluding user content). You may not copy, modify, or reuse our branding, design, or materials without prior written consent. “BodyPlan” is a registered trademark in the UK and USA.

7. Limitation of Liability

To the maximum extent permitted by law, BodyPlan and its affiliates disclaim all warranties, express or implied, including fitness for a particular purpose. BodyPlan shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill.

You agree to release, indemnify, and hold harmless BodyPlan, its directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of your use of the service.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the laws of England and Wales.

8. Privacy

Your personal data is handled in accordance with our Privacy Policy.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
